- New Anti-Bullying Legislation [download]
We have recently delivered lectures on the new anti-bullying amendments to the Fair Work Act 2009 which commenced on 1 February 2014. Our powerpoint presentation (drawn largely from the Fair Work Commission's Benchbook on Anti-Bullying) is available.
There have been only a few decisions on the new legislation although many applications have been filed. Features of the decisions made so far include:-
Incidents before and after 1 February 2014 can be taken into account in determining whether an action can lie under the new legislation (McInnes  FWCFB 1440); and
The width of orders can be broad including prevention of contact between the parties to the bullying, prevention of comments about persons bullied and variation of an employee's start time at work.
Policies should be reviewed after the introduction of this legislation and we can undertake that for you if required.
